Don't despair. I work and live in Scotland too where it is also illegal to give a bad reference. I answered a similar question here a few days ago and have pasted my answer here. I hope this answers your question:---------------------------
Like someone has said above me it is illegal for anyone to provide a highly inflammatory (bad) reference. However, this law applies to the UK as a nation and not just England. It is also legal for you to see the reference prior to being submitted to any potential employer, if you so wish, and can ask for them to be amended. You are in control of the references they submit not them.
I work for a local authority and can tell you that there have been a number of Industrial Tribunal cases that have ended up with the local authority losing at every turn on this issue. Now all references, no matter who they are addressed to, must be completed by HR with only factual information provided i.e. dates of employment, any disciplines etc. They cannot say, for example, that you were a horrible worker or that you weren't liked. This information is based on opinion and highly inflammatory i.e. not based on fact.
Again, YOU are in control of the reference. Do not accept anyone if they say that they cannot provide you with a copy of a reference or if you chose to read prior to submission. This is your LEGAL right!

If I were you I'd call the Citizens Advice Bureau on 0844 848 9600 or contact Acas helpline on 08457 474747 (8:00 am - 8:00 pm). Advise them that it is concerning grievances. You can get great advice from them on how to proceed. You certainly have a good case, as you currently hold a copy of the reference.

People who hate translation tools are just as bad as people who hate wikipedia. So long as you know how to use it, it's fine.Just use google translate using english-->spanish. Then translate it back into english to see if there are any mistakes. Works over 90% of the time.
