scam - a legitimate company would do a phone interview, in house interview, and background check.

no you should not. maybe thats why that employer was looking for a better job, maybe the boss does not know how to treat his employees. There is nothing wrong with someone looking to better them self, and he had a reason for wanting a new job, weather it be more money, more hours, benifits, or maybe a better boss. he should not loss the chance at a better job, just because his boss doesn't want him to go.

you can let her go tomorrow - companies do that all the time so the person leaving cannot sabotage anything - you are under no obligation to let her stay the full week

if she is a 1099 "subcontractor", she is NOT an employee and is not entitled to unemployment, so don;t worry about that - she will not show up in teh unemployment system under your company name is you did not file state unemployment tax returns

just call her tonight and tell her not to come in at all anymore if she doesn't have anything she needs to return - keys, cell phone ,company computer, etc

keep in mind - is the employee is just working in your office doing clerical work, that type of position cannot legally be paid as a 1099 - doesn't qualify - your next employee - you better do it right - w-4, I-9, withhold taxes, deposit taxes, get signed up as an "employer" at fed and state levels, file payroll tax returns, issue w-2's at end of yr, etc
