So...you're backing out of a parking space and she's backing down a parking lot isle = not completely her fault. Best you can hope for in this situation is it gets ruled both your faults.

However, if she says that she was stopped in the parking isle and you backed out and hit her- there's a chance it would be deemed your fault.

All you can do is tell your story to the adjuster for your insurance company and let them photograph your car. The adjuster will speak to both drivers and get photos of both cars. Sometimes, the adjuster gets photos of the accident scene. Then the insurance adjuster makes a decision regarding liability. Since we don't have access to all this information - no one here can tell you how the adjuster will rule on liability.

My advice to you is that if both you and your son are unhappy with that daycare , then you should find a new one. The teachers should know every time there is a mark and are supposed to document every accident for their records. It also seems as if the teachers are not sympathetic to him at all which is terrible. Trust me, I've been there and thank God my son's teacher was patient and loving and sympathetic and he finally got adjusted. The bottom line is that you should not leave your child anywhere that you have reservations about. Your son can sense that and he will probably never thrive there. I say find somewhere else and really talk to your husband about how serious a problem it is. Leaving your son in a place where he is allowed to be called a cry baby and where there seems to be no positivity is NOT a place for him to be.
