The IRS "rule" is you need to report all of your tips, cash and credit card (which it appears you are doing).

As long as you are doing that, it doesn't matter what the restaurant/establishment/others are doing. As long as you are following the rules, you will be fine.

the restaurant may get audited if someone tips off the IRS, or the IRS just decided to audit them, at which point they may look at the staff as well, but as long as you are following the rules you are fine.

Your best bet: talk to him. Filling out notes more than 24 hours post treatment is not good, and has to be noted. From a legal standpoint - it's not necessarily illegal, but rather against insurance contracts. If medicare wants notes and they're just 'made-up' then there will be very large fines and they WILL FIGURE IT OUT. Yes, it is unethical practice. From an insurance perspective, chiropractors are primary care physicians. Meaning, their notes should be much like any doctor (MD) you would see.

Notes aren't fun, but they are absolutely necessary. Don't bother reporting him, because it will come back to haunt him no matter what.
