The self employed taxpayer should always have the receipt book available to issue a receipt for the amounts of each payment that is received from the taxpayers that the SE taxpayer independent contractor is performing the services for and when the payments are made to the SE taxpayer and keep the copies of all of them for use as needed to prove that all of the gross income for the tax year is correct when preparing the correctly completed 1040 federal income tax return after the end of the tax year.
You really do need to have some very good records of all of your business operation income and expenses available to you when you complete your schedule C and SE of the 1040 federal income tax return completely and correctly after the end of your tax year and the tax return is being sent to the correct IRS address.

It depends on what position you have. Waitstaff do not generally qualify for anything due to their compensation, although they are required to make at least minimum wage after tips including overtime.

For a normal establishment, you are entitled to overtime as a standard worker.

In addition, an employee may file a private suit, generally for the previous two years of back pay (three years in the case of a willful violation) and an equal amount as liquidated damages, plus attorney's fees and court costs.

It is a violation of the Act to fire or in any other manner discriminate against an employee for filing a complaint or for participating in a legal proceeding under the Act.
