Writing A Legal Letter

writing a legal letter?We Answered:
It sounds like your injuries are more the reason they are turning you down. There does not need to be a prior letter - a skillfull attorney could prove that the steps were defective based on a theory of "constructive notice" depending on how the stairs looked. If they were in bad shape (i.e. warped wood, cracked, or just plan looked old and beat up) that would be sufficient. There is a legal principle called "constructive notice" that says if the condition looked as if it was in existence long enough that a premises owner SHOULD HAVE KNOWN then that is sufficient. Again, this would depend on the condition of the steps and how they looked before your accident.
Also, if they were called before your accident that too would be sufficient if you could get that person to agree to sign an Affidavit or testify if you filed suit. The law does not require that the notice be in writing.
But, to be honest with you, if you called me and told me all you had were some stitches and an as-yet undiagnosed arm injury, I too would turn your case down.
Get some pictures of the stairs immediately. Then, go get some treatment for that arm. You may need some nerve testing to find out what is going on. If your only injuries are stitches and a painful arm that hasn't been treated by a doctor, then your case is going to have very little value, maybe $1500.
Any personal INJURY case is going to live and die on the medical records and medical treatment. If you have nerve damage or something else long-term with that arm, or at LEAST a scar where the stitches were, then you should have a case that a lawyer would take. However, a self-diagnosis of arm pain is NEVER sufficient for a lawyer to pursue a case.
Until you get some additional treatment and get a doctor to tell you whether or not you injured that arm, no lawyer is going to take that case.

I need someone who is good with writing legal letters to help me?We Answered:
I'm not an attorney so I'm just offering a suggestion here.I hope your husband really wants a job performing the type of work he will be doing.
I hope that the letter of recommendation is worth it's weight in gold because a year's worth of unpaid work had better be compensated in some form.
You could try to put something in the letter that will give you both an out: such as I look forward to committing to you for a position for a year and will continue in this capacity as long as we both find the arrangement to our liking. Something like that should satisfy both your husband and the doctor.

Tucker's Fix-It-Quick Garage
9938 Main St.
Chicago, IL 61390
July 1, 2006
Dear Mr. Tucker,
On February 15, 2006, I took my car to your garage for servicing. Shortly after picking it up the next day, the engine caught fire because of your failure to properly tighten the fuel line to the fuel injector. Fortunately, I was able to douse the fire without injury to myself.
As a direct result of the fire, I paid the ABC Garage $681 for necessary repair work. I enclose a copy of their invoice.
In addition, as a direct result of the fire, I was without the use of my car for three days and had to rent a car to get to work. I enclose a copy of an invoice for the rental cost of $145.
In a recent phone conversation, you claimed that the fire wasn't the result of your negligence and would have happened anyway. You also claimed that, even if it was your fault, I should have brought my car back to your garage so you could have fixed it at a lower cost.
As to the first issue, Peter Klein of the ABC Garage is prepared to testify in court that the fire occurred because the fuel line was not properly connected to the fuel injector.
Second, I had no obligation to return the car to you for further repair. I had the damage you caused repaired at a commercially reasonable price and am prepared to prove this with several higher estimates by other garages.
Please send me a check or money order for $826 on or before July 15. If I don't receive payment by that date, I'll promptly file this case in small claims court.
You may reach me during the day at 555-2857 or in the evenings until 9 p.m. at 555-8967.
Sincerely,
Marsha T. Rizzoli

Writing a legal letter?? help..?We Answered:
Before you write the letter, find out when you have to file your case. There's something called a statute of limitations that governs how long you have to file your case and it varies, depending on the type of claim and what state you are are. Most states have a 1 or 2 year statute of limitation on personal injury case. If you're close to your deadline, file a lawyer right away or file the suit on your own behalf and try to find a lawyer afterwards. If you have plenty of time, there are no magic words to put in the letter. Usually, letters like the one you are thinking of writing are not admissible as part of the personal injury case, so don't worry to much about any critical language. Just explain what happened, what your injuries are, what medical treatment you've had, and how much money you've lost if you missed any work. If you have pay stubs and medical bills that reflect these costs, send copies of those too.
Get well and check that statute of limitations as soon as possible.

Can anyone give me some tips for writing a legal letter with an offer to settle outside of court? We Answered:
You won the judgment but you want to offer to settle out of court because you feel sorry for him? Use your head, not your heart, here. He's the one who needs to ask for an out-of-court settlement and make an offer. If you won a $3,650.00 judgment, you need to get $3,650.00, not a penny less. Otherwise, you wasted your time in going to court to get this amount. If you decide to do this, ask for the full $3,650.00, giving him 24 hours to pay, or 36 hours, or something like that, but not 2-3 weeks or months. If you say he has the money to pay this, then he needs to pay it NOW. It if goes into a payment hearing, the judge will order it paid right then, on the spot. He doesn't pay, he goes to jail and still he has to pay. that's the way it works. (Are you in the U.S.?)
