You haven't provided nearly enough information for anyone to be very helpful.

First, where do you live? (The laws vary based on jurisdiction.) How long was your lease? Has the lease ended? If the lease is over, when did it end? If the lease has not ended, why is your landlord wanting to boot you?

If your lease ends at the end of this month, then yes, you would be expected to vacate by the end of the month and you would not be entitled to extra notice. If your lease ended last month, then, yes, you need to be out now . . . unless they accepted your rent for the month of November - then you would be expected to move out before December 1st.

Generally, a holdover tenant (someone who stays beyond the end of their lease) can't be evicted without going to court. The rules governing this vary from jurisdiction to jurisdiction. In my state, the landlord files an Unlawful Detainer action, serves it on the tenant, and goes to court within about two weeks. The landlord gets a Writ of Restitution and a judgment against the tenant (usually for the back rent, plus the fees and costs associated with getting the eviction - usually about $800) and then takes it to the Sheriff's department to have a deputy exercise the Writ. The downside, is that a tenant who makes the landlord file an action in court will have an eviction on his/her record - regardless of whether or not they move out before the court date. This makes it harder for the tenant to find a new place to live in the future.

She Has to Have you served By the sheriff department before she can evict you.Then you go to court and tell the judge your situation and sometimes the judge will give as long as you need to find other living arrangements. The lease being drawn up wrong the judge may let you stay through the entire lease free. Do not let this lady treat you that way.What state do you live in?

As for the letter, all you have to do is write down that the roommate has failed to pay their share, specify the amount of money, and that they have two days to pay in full. Get it notarized, make a copy, and send the copy by certified mail.

Relax, they neither want the hassle or the expense of evicting you, especially over someone whining about your dog barking.

If you are concerned about your safety do not write the letter. I'm certain your former landlord will have other means available to help with their eviction if this tenant really is as bad as claimed.
