You can start by explaining why the notice went to the wrong address. The judge is under no legal obligation to give you a new court date. Having a reasonable explanation will increase your chances.

In a divorce situation, the judge does not really have time to read all the letters and listen to the tapes. Mediators are for that . Tell me something, why didn't your attorney speak up for you. That is why you pay so much money to do so. Also, depending on which state you live in, there is no such thing really as 50/50 custody. Some has to have 49/51 percent per the child support law. Worry more about who will carry the primary custody. As hard as it is, with as ill as your son is, how does he feel about having his parents with him at this sad and difficult time. My heart goes out with you, and your son. You can still maintain a joint custody just make sure your attorney earns the money you paid him/her for the primary custody to be in your favor. We all need to understand that joint custody does not give the other spouse the right to take your son anymore then what is written in the order and stipulation. Hope this helps, I am a para legal.

My advice is: DON'T write to the Judge!! It would be better if you would get an attorney, and have the attorney talk to the Judge! (warning)

THE best way to find a lawyer is by word of mouth. Ask your: family, friends, coworkers, anyone you might know in the same situation, etc.

OR

Call your local (usually county) bar association. Ask for names of attorneys that handle criminal law. (If money is a BIG problem, you could also ask for the phone number of your local LegalAid office. - the attorneys at LegalAid are "real" attorneys, but sometimes in the field of Law, how much you are willing to pay does affect the quality you get.)

When you call the law office(s), insist on speaking with the Lawyer. Do not tell all the little details of your matter to the Secretary - save the details for the Attorney. When you get the Lawyer on the phone line, ask him/her:

-Do they give FREE, initial consultations? (most do, but not all - you have to ask, don't assume)
- How much do they charge?
- Could you make payments on your account?
-Can they help you? OR Refer you to someone who can help you?

Good luck on that one, while the justice system states you are entitled to a lawyer under certain criminal complaints, it does not state the lawyer must be the cream of the crop, so absent a showing of malpractice on the part of your public defender, the fact you have a average or below average public defender may not be just cause for the courts to appoint a new public defender, you need to show incompetence

A simple letter asking requesting for a new public defender, simply stating the reason why you feel the current lawyer is not doing their job, but as I stated I would not get my hopes up that the court will appoint a new public defender

In majority of states the state bar association is a voluntary organization as such has no real power, the states Supreme Court ethics committee is the ultimate authority over lawyer professional conduct

that is basically it. explain to them your financial situation and the reason why you can't pay right away. they should be able to work out a payment plan that will work for you. it doesn't have to be written professionally. when i was in virginia i recieved a speeding ticket and they wanted me to show up in court the day after i was supposed to head back home. i wrote them a quick letter stating my reasoning and they just sent me a ticket in the mail. no questions asked
