How should I go about writing this law essay?

To start with, go straight to the statutory language. When you have been given 2 statutes as part of the question, that is clearly the best place to start. Analyze whether the plain text of the statutes actually does resolve any inadequacies in the criminal law relating to IT or whether there is any ambiguity in the language that may still leave a gap.

Then, research cases discussing those statutes. You will want to search for cases not just in the text and in journal articles, but also using Westlaw, LexisNexis, LoisLaw, (if you have access to them through your school or local library) or at least look on Findlaw.

To do the actual report, legal writing is issue-oriented. Use these steps:

1. Identify an issue (i.e. a perceived inadequacy).
2. State the rule that applies to that issue (from the statute or the case law).
3. Explain the rule.
4. Analyze how the rule applies to this particular issue.
5. Reach a conclusion.

Then, repeat those steps for each issue you are planning to discuss.

To cite the statutes and cases using proper legal format, refer to The Bluebook: A Uniform System of Citation.

You could start from comparing two extremes.

1. Prison as entirely a deterrent and punishment - make the experience so bad that they will not risk a return.

Raises issues of further brutalising taking place, negative responses to the experience that reinforce identity as second class citizen, build up of resentment that will have its outlet somehow ... etc.

2. Prison as entirely rehabilitation - founded on belief that offenders have had deprived life-chances and they deserve a chance to catch up.

Raises issues of creating an environment that is infinitely better than many offenders have previously experienced and a spell inside will be akin to a free holiday, tax-payers money spent on offenders when pensioners are deprived, ... etc.

Between these are positions where 'carrots and sticks' are deployed e.g. behave, learn, cooperate, conform, achieve and you can have the X-box, day release, open prison ... etc.

This formula works for most law essays.

what is looked for in this essay is essentially how law is changed and enacted and what rules and legal principles allow this and how it is justly and rightly brought about.

any essay must have a begining, middle and end. at the start identify the laws and principles and how they work. in the midddle, the bulk, give examples of the social/scientific law to illustrate the points made and back up opinions you express. In the conclusion sum up all that you have said concisely and emphasis the main point you are making again.
the most famous social change law is the womens right to vote.
