If the standard admission test for your field requires an essay, the test essay and your application essay will be compared and you probably will be caught.

I'm a professor and I know that its not illegal. It is against college policies though so it might as well be. If you do it, we literally have the right to do whatever we want to you: fail you, fail you completely, kick you out, demand you do whatever stuff we want or we will kick you out, and more. Its really just to teach you that if you steal other peoples ideas out in the real world, the results will be drastic and there are legal implications to doing that. Being a math professor, I could really care less, but I do know that English teachers here at least are damn good at picking out stuff not written by the author. I don't know how they do it, but they have a reputation here!
