There are tradition methods for legal writing they teach in L1. The most common is:

IRAC: Issue, rules, analysis, conclusion

The other that some prefer, including bar examiners is :

CraC: conclusion, rule, analysis, conclusion

If you go the IRAC route, you need to create in issue statement that should go something like this:

1. The issue is whether B can sue S for specific performance when he refused to tender the deed to the parcel on the sale contract closing date. I know that seems simple but legal writing is not about bells and fancy ribbons. Its about communicating in plain English, despite what you may have been told. Lawyers do not write in "thou" and "thee" or talk about Mens Rea. Judges wouldn't know what the hell you were talking about either. Simple, plain, repetition until you got the process down is the best route. The issue is..the rule is...and don't forget to use as many 'because" as you possibly can.

2. Rule is whatever the law is ...Specific performance is X, A deed is Y, a sales contract requires, Z, the risk of loss passes when, Abc happens..etc etc. Usually requires strict memorization on an exam. If its a take home assignment, just look it up and copy it.

3. Analysis: This is the most important part, and law students skip on it when they are first starting out. You must apply the facts to the rule. It seems simple but it takes a lot of practice. What I do is I map out my facts. I assign a rule to each of my facts to make sure I have them all covered. Also don't forget to argue both ways if the issue seems ambivalent. Law professors love it when you come to the conclusion of "on the other hand.." But if your on a time limit beware. Getting down the main argument is most important. Unless its a question where they ask you to compare something obviously.

4. Conclusion is not important in law school. But still you should say something like: Therefore, S should win because of .... In bar exam writing conclusion becomes more important but I wouldn't worry to much about that now lol.

The first thing you need to do it start by putting your ideas on strips of paper. You might even look at an internet source for an outline idea since you have no clue what you're writing about.

Start with something as simple as, "What is energy?" Then explain the quote. Don't go for the typical formula of five paragraphs unless your teacher specifically requires it.

Also, if organization and having a clue is difficult for you or if you are going into a future with difficult topics such as this, consider looking at www.meadbuilder.com. There is a new resource, Mead Builder, available for writing essays that will make your life much easier. I have been using it with my students and they refuse to do an essay without it now.

Caveat Emptor. Provided the vendor is not deliberately misleading the purchaser, there is no case to answer. She had ample opportunity to see how the business was being run and should have asked the right questions - like what is the turnover for previous years rather than months. The description does not imply that there is any guarantee that 'stars' will turn up. (how are we defining 'stars' these days is anyone's guess).

The accountant however is presumably negligent as his advice is rubbish. She should sue the shiny pants off him.
